THIS PRIVACY POLICY (“POLICY”) GOVERNS THE PROCESSING OF PERSONAL INFORMATION BY THE WYKEHAM COLLEGIATE IN CONNECTION WITH THE WYKEHAM COLLEGIATE’S ARCHIVE WEBSITE (“WEBSITE”) LOCATED AT http://wykeham.africamediaonline.com/. 2. CONSENT TO PROCESS YOUR PERSONAL INFORMATION

1. The Wykeham Collegiate endeavours to comply with all laws and regulations applicable to The Wykeham Collegiate pertaining to information and communications privacy including, but not limited to, the 1996 South African Constitution and the Protection of Personal Information Act 4 of 2013 (“the Act”). The Wykeham Collegiate applies the principles of protection of Personal Information under such Act and further legislation referred to in the Act.
2. The Wykeham Collegiate seeks to ensure the quality, accuracy and confidentiality of Personal Information in its possession. You warrant that all personal information supplied by You is both true and correct at the time of provision. In the event of any aspect of Your personal information changing post submission, it is Your responsibility to immediately notify The Wykeham Collegiate of the said changes by email toAmy Warr. You agree to indemnify and hold The Wykeham Collegiate, its officers, directors, employees, agents, and suppliers harmless from and against any claims, damages, actions and liabilities including without limitation, indirect, incidental, special, consequential or punitive damages arising out of The Wykeham Collegiate’s reliance on Your personal information should Your personal information contain any errors or inaccuracies.
3. You warrant that You have the authority, permissions and consents to provide The Wykeham Collegiate with any third party information submitted to The Wykeham Collegiate.
4. The Wykeham Collegiate will take all reasonable measures in order to ensure Your Personal Information is appropriately safeguarded, these precautions include, but are not limited to: access control mechanisms via username and password, and software protection for information for security.
5. Should an unauthorised person/s gain access to Your Personal Information The Wykeham Collegiate will contact You within a reasonable time to inform You of such access.
6. The Wykeham Collegiate may share Your PersonaI Information with authorised third parties such as service providers to The Wykeham Collegiate. These include, but are not limited to digital archiving service providers. The Wykeham Collegiate does not permit these parties to use such information for any other purpose than to perform the services that The Wykeham Collegiate has instructed them to provide. All processing is compatible with such purpose.
7. The Wykeham Collegiate may appoint certain agents, third parties and/or service providers which operate outside the borders of the Republic of South Africa. In these circumstances The Wykeham Collegiate will be required to transmit Your Personal Information outside South Africa. The purpose of the trans-border transfer of Your Personal Information may include, but is not limited to: data hosting and storage. You expressly consent to the trans-border flow of Your Personal Information.
8. The Website may contain links to other websites. The Wykeham Collegiate is not responsible for the privacy practices of such third party websites.
4. RECORDS OF PERSONAL INFORMATION
1. Records relating to the provision of The Wykeham Collegiate products and/or services by The Wykeham Collegiate to You and the Personal Information submitted by You is retained for publication on the Website and/or to provide you with the Website services.
2. Such records may be required to be retained in terms of legislated records retention requirements, The Wykeham Collegiate’ operational purposes and/or for production as evidence by The Wykeham Collegiate in legal proceedings.
3. In terms of Section 14(2) of the Act records of personal information may be retained for periods in excess of those contemplated in 4.1 for historical purposes. The Wykeham Collegiate warrants that appropriate safeguards are in place to prevent the records being used for any other purpose.
4. The Wykeham Collegiate may disclose Your Personal Information under the following circumstances: 4.4.1 To comply with the law or with legal process;
1. To protect and defend The Wykeham Collegiate’s rights, equipment, facilities and other property;
2. To protect The Wykeham Collegiate against misuse or unauthorised use of the Website and/or products and/or services; and/or
3. To protect other Website Users or third parties affected negatively by Your actions in use of the products/services and/or the Website.
5. ACCEPTABLE USE
In connection with the Digital Archive Material (as made available through the Website) You agree that:
1. No Item containing the image of or reference to a person is to be used for a purpose other than for which rights are granted by The Wykeham Collegiate, without prior express written permission of The Wykeham Collegiate.
2. Only a single digital copy of an Item may be stored on a single computer, hard drive, or any other storage device, and that that copy may not be duplicated in any way whatsoever, except for a single backup copy which may only be used in the event of the original being deleted, lost, or irreparably damaged.
3. Once the Item has been used for the purpose for which use rights were granted, all copies of the Item must be deleted, apart from where it forms part of the archive of what was published.
6. OBJECTIONS, COMPLAINTS AND QUERIES
1. Should You have any questions about this Privacy Policy, require a correction to be made to Your Personal Information that The Wykeham Collegiate keeps on record, request a copy of the record itself, lodge an objection to the collection, Use or processing of Your Personal Information by The Wykeham Collegiate, or delete Your personally identifiable information, you may send an e-mail to oldgirls@twc.org.za
2. There may be instances where we cannot grant You access to the Personal Information we hold. We may need to refuse access if granting access would interfere with the privacy of others or if it would result in a breach of confidentiality. Should this be the case, we will give You written reasons for any refusal.
